These Terms of Service (“Terms”) govern your access to and use of the ai42001.ai platform, assessments, and digital products (the “Service”), operated by ITG insights Co., Ltd. (“we”, “us”, “our”). By accessing or using the Service, you agree to these Terms.
1. The Service
ai42001.ai provides an ISO/IEC 42001 AI governance readiness assessment platform and related digital products. This includes a free self-assessment (Tier 1) and a paid remote expert assessment (Tier 2), together with the AI Governance Toolkit (downloadable document templates with bundled AI Threat Intelligence access). On-site assessments are available in the Republic of Korea by separate arrangement. Paid assessments provide platform access, an automated readiness report with maturity scoring and industry benchmarking, and an expert review of your submission.
2. Payments and Merchant of Record
Purchases are processed by Paddle.com Market Ltd (“Paddle”), our reseller and Merchant of Record. Your purchase is therefore also subject to Paddle’s buyer terms and privacy policy, and Paddle is responsible for billing, payment processing, and applicable sales tax/VAT. Prices are shown in US dollars and include applicable taxes where indicated.
3. Access
Paid assessments are accessed through a unique link/token issued to the email address used at purchase. This link is issued for the purchasing organization’s use; please keep it confidential and do not share it outside your organization. You are responsible for activity conducted through your access link.
4. Customer content and evidence
You may upload documents and provide information (“Customer Content”) to complete an assessment. You retain ownership of your Customer Content. You grant us a limited license to process it solely to provide the Service. You represent that you have the right to provide it and that it does not infringe any third-party rights or applicable law. Our handling of personal data is described in our Privacy Policy.
5. Intellectual property
The platform, questionnaire, scoring methodology, benchmarking data, and report templates are owned by us or our licensors. We grant you a non-exclusive, non-transferable license to use your assessment report for your organization’s internal purposes. You may not copy, resell, or commercially exploit the platform or its methodology. Licensing of the AI Governance Toolkit and Threat Intelligence is set out in Section 6.
6. AI Governance Toolkit and Threat Intelligence
The AI Governance Toolkit is provided as downloadable document templates (available as Complete, Risk Management Suite, and Impact Assessment Suite editions). We grant you a non-exclusive, non-transferable license to use and adapt the templates for the internal AI governance purposes of the purchasing organization. You may not resell, redistribute, sublicense, publish, or otherwise make the templates available to any third party outside the purchasing organization, whether or not modified.
Each toolkit edition includes access to our AI Threat Intelligence for twelve (12) months from purchase. Threat Intelligence is provided on a pull basis through a unique Access ID and is licensed for the internal use of the purchasing organization only; it may not be redistributed. Delivered templates and Threat Intelligence materials are watermarked and traceable to your purchase to deter unauthorized sharing.
Threat Intelligence access expires at the end of the 12-month term unless renewed. Access may also be revoked, and the license to the delivered materials terminated, where a purchase is refunded or these Terms are breached, as described in our Refund Policy.
7. No certification; not legal advice
The readiness assessment provides an indicative evaluation of your organization’s preparedness against ISO/IEC 42001. It is not an accredited certification audit, does not constitute ISO/IEC 42001 certification, and does not guarantee any certification outcome. The Service does not constitute legal, regulatory, or professional compliance advice. You remain responsible for your own compliance decisions.
8. Benchmarking
We use de-identified, aggregated assessment data to provide industry benchmarking. Benchmark comparisons are shown only where a sufficient number of comparable responses is available, and benchmark outputs do not identify any individual organization.
9. Acceptable use
You agree not to misuse the Service, including by attempting to gain unauthorized access, disrupting the Service, uploading malicious or unlawful content, or using the Service in violation of applicable law.
10. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
11. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to the Service will not exceed the fees you paid for the relevant assessment or product. We are not liable for indirect, incidental, special, or consequential damages. Nothing in these Terms limits any liability that cannot be limited under applicable law.
12. Refunds
Refunds are governed by our Refund Policy.
13. Term and termination
We may suspend or terminate access for breach of these Terms or misuse of the Service.
14. Governing law and consumers
These Terms are governed by the laws of the Republic of Korea, and the courts of the Republic of Korea shall have jurisdiction. If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer-protection laws, you continue to benefit from any mandatory provisions of the law of your country of residence, and nothing in these Terms removes those protections.
15. Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance.
